A federal lawsuit filed by Spurs star Victor Wembanyama has been resolved just a month after it was filed.
Wembanyama has dismissed his claims against James T. Glodich, an Austin businessman accused of using the player’s nickname and likeness without authorization to sell branded merchandise, after the two sides reached a settlement. No details of the agreement were disclosed in court papers.
Neither Wembanyama’s Austin lawyer nor Glodich responded to requests for comment Tuesday.
The case was closed Nov. 15 by U.S. District Judge Robert Pitman in Austin.
Glodich never filed an answer to Wembanyama’s complaint.
The towering Frenchman sued him alleging invasion of privacy and false endorsement over unauthorized use of his “Wemby” nickname on coffee mugs, sweatshirts and other items.
Wembanyama was seeking unspecified financial damages and an injunction directing Glodich to cease using the player’s name and likeness and invading his privacy. The suit says Glodich never responded to demands from Wembanyama’s lawyers that he stop his activities.
Glodich registered the domain name wembysworld.com, where he was selling merchandise. Visitors to the site Tuesday were greeted with the message “Coming Soon.” Last year, though, it was peddling $40 coffee mugs, $115 hooded sweatshirts and other items bearing Wembanyama’s likeness and nickname.
At the time, the San Antonio Express-News reported on how a range of businesses and individuals — including Glodich — were swarming to capitalize on Wembanyama’s rising popularity by trying to trademark the “Wemby” nickname or incorporating it in branding.
Glodich unsuccessfully sought to trademark “Wemby’s World” and “El Wemby.”
The U.S. Patent and Trademark Office earlier this year refused his applications to register the names on the grounds they they “may falsely suggest a connection” with the athlete. Glodich never responded to the agency’s actions, so it deemed both applications abandoned.
