Los Angeles Sparks forward Dearica Hamby on Monday filed a lawsuit in a Nevada federal court against the WNBA and the Las Vegas Aces, alleging unlawful workplace discrimination and retaliation related to her pregnancy.
Hamby was originally drafted sixth overall by the San Antonio Stars in 2015 and remained with the franchise when it relocated to Las Vegas in 2018, spending her final two seasons playing under former Spurs assistant-turned-Aces head coach Becky Hammon before being traded to the Sparks on Jan. 21, 2023.
According to the lawsuit, Hamby informed Hammon and the Aces’ coaching staff of her pregnancy on Aug. 6, 2022, three days before the end of the regular season. An All-Star that year, Hamby appeared in six of 10 playoff games as Las Vegas won its first WNBA championship and publicly announced her pregnancy on Sept. 20 during the team’s victory parade.
That moment marked a significant shift in the way Hammon and the Aces treated her, the lawsuit alleges. That included the team directing Hamby to vacate the team-provided housing, forgoing a promise to cover her daughter’s private school tuition costs and questioning her commitment to the team.
During a phone call in January 2023, Hammon allegedly told Hamby she was "not taking proper precautions not to get pregnant” and labeled her a “question mark” as Las Vegas prepared for its title defense. At the time, Hamby was still partaking in workouts and training, as permitted by her doctors, while seven months pregnant.
During a phone call later that month, Hammon informed Hamby her “time with the Aces” is up while suggesting some potential trade destinations for the two-time Sixth Woman of the Year winner. On Jan. 21, 2023, Las Vegas traded Hamby – against her wishes – and a 2024 first-round pick to the Sparks for forward Amanda Zahui B. and a 2024 second-round pick.
That same day, Hamby issued a public statement through her Instagram account. “Being traded is part of the business,” she wrote. “Being lied to, bullied, manipulated, and discriminated against is not."
Hammon refuted those allegations.
“We made the decision to move Hamby because we could get three bodies in her one contract, and we wanted to get three more people in," Hammon said at the time, per the Associated Press. “I think it’s very evident (with) who we signed on why we made the move.”
Through her attorney, Hamby requested the WNBA investigate her allegations of workplace discrimination on Jan. 23, 2023. That May, the WNBA concluded its investigation and imposed penalties on both the Aces, who would forfeit their 2025 first-round pick, and Hammon, who was fined two games without pay for “violating league and team Respect in the Workplace policies.”
The new lawsuit filed this week in Nevada accused the WNBA of both failing to meaningfully redress Hamby and taking no steps to address a violation of her rights under federal and state anti-discrimination law. The lawsuit states Hamby is seeking compensatory damages.
In a statement issued Monday, a WNBA spokesperson said "We are aware of today’s legal filing and are reviewing the complaint.”
Hamby, who gave birth to her son on March 6, 2023, is currently having a career year with the Sparks. She was selected to her third All-Star team and is currently averaging 19.2 points, 10.0 rebounds, 3.5 assists and 1.4 steals. Hamby also helped the United States win bronze in the women’s 3x3 tournament at the Paris Olympics.
